 MRBALLEN AUTOGRAPHED LUNGY BUCKET HAT  GIVEAWAY

NO PURCHASE IS NECESSARY TO ENTER OR WIN. The giveaway is focused on United States based entrants giving them a chance to win one (1) Autographed Lungy Bucket Hat in exchange for subscribing to the Wondery Shop Newsletter with the Sponsor via the giveaway application form (the “Giveaway”) which is subject to the rules below (the “Rules”). 

1. Eligibility: This Giveaway is open to legal residents of the United States who sign up at the Giveaway page https://wonderyshop.com/pages/mrballen-lungy-bucket-hat-giveaway and who are 18 years or older as of the date of entry (“You” or the “Entrant”). Employees of Sponsor are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. The Giveaway is void where prohibited by law.
   
   

2. Sponsor: The sponsor of the Giveaway is Snow Commerce, Inc., an Ohio corporation, with a principal place of business at 1340 Clay St., Cincinnati, Ohio 45202, United States (“We” or the “Sponsor”) on behalf of Wondery LLC, a subsidiary of Amazon, a Delaware corporation, with a principal place of business at 9300 Culver Blvd, Suite 201, Culver City, CA 90232(the “Client”). The Giveaway may be promoted on social media platforms.  Any such social media platforms are not affiliated with the Giveaway in any way and are not responsible for the administration of the Giveaway or the awarding of the Prize.

3. Agreement to Rules: By participating, You agree to be fully unconditionally bound by these Rules. You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of the Sponsor as final and binding as they relate to this Giveaway. 

4. Modification to Rules: Sponsor reserves the right, in its discretion, to modify these Rules at any time. You are responsible for reviewing and becoming familiar with any such modifications.
   
   

5. Giveaway Period: Entries to the Giveaway will be accepted online starting on July 3, 2025, at 12:01 AM, EST, and ending on July 13, 2025, at 11:59 PM, EST.
   
   

1. How to Enter: The Giveaway must be entered by signing up for the Wondery Shop Newsletter by providing an email address using the online form provided at the Giveaway page https://wonderyshop.com/pages/mrballen-lungy-bucket-hat-giveaway. The entry must fulfill all Giveaway requirements as per these Rules for the Entrant to be eligible to win the Prize. Entries that are incomplete or do not adhere to these Rules or specifications may be disqualified at the sole discretion of the Sponsor. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these Rules. 

5. Prize: The prize is (1) Autographed MrBallen Lungy Bucket Hat signed by MrBallen (the “Prize”). The specifics of the Prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except at Sponsor’s discretion. Any and all Prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the respective Winners. No substitution of the Prize or transfer/assignment of the Prize to others or request for the cash equivalent by the Winners is permitted. Acceptance of Prizes constitutes permission for Sponsor to use Winners’ names, likenesses, and entries for purposes of advertising and trade without further compensation, unless prohibited by law. 

6. Odds of Winning: The odds of winning depend on the number of eligible entries received.

6. Winner Selection and Notification: From all the qualifying entries the Sponsor will randomly select one (1) winner using an online tool on July 14, 2025 (the “Winners”). Each Winner will be notified by an email within five (5) days following the selection date. The Sponsor shall have no liability for a Winner’s failure to receive notices due to spam, junk email or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the Prize within seven (7) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the Prize may be forfeited and an alternate Winner selected at random from among all remaining eligible entries. Receipt by the Winner of the Prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE RULES BY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
   
   

7. Rights Granted by You: By providing your email address, first name and last name in connection with the Giveaway, you understand and agree that Sponsor and the Client, as well as anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
   
   

8. Additional Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, the Sponsor may select the Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any Entrant who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void votes for any reason, including, but not limited to: multiple entries from the same Entrant from different IP addresses; multiple entries from the same computer in excess of that allowed by these Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an Entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
   
   

9. Limitation of Liability: By entering, You agree to release and hold harmless Sponsor, Client and each of their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors (the “Indemnitees”) from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such Entrant’s participation in the Giveaway and/or their acceptance, possession, use, or misuse of any Prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error in the administration of the Giveaway or the processing of entries.
   
   

10. Waiver: By participating in this Giveaway, the Entrant agrees that the Sponsor will have no liability whatsoever (jointly and severally) for, and will not be held liable by the Entrant (jointly and severally) for any intellectual property-related claims, bodily injury, loss, cost or damage of any kind to people, including death and property damages sustained due in whole or in part, directly or indirectly, from Your creation, use, or intended use of Your entry, participation in this Giveaway, and the acceptance, possession, use or misuse of the Prize.

11. Governing law and jurisdiction: This Giveaway is governed by the laws of the United States of America and the State of Ohio, without respect to conflict of law doctrines. As a condition of participating in this Giveaway, the Entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resorting to any form of class action, exclusively before a state or federal court located in the State of Ohio having jurisdiction. Further, in any such dispute, under no circumstances shall the Entrant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Entrant’s actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). Entrant further waives all rights to have damages multiplied or increased.
    
    

12. Privacy: By participating in this Giveaway, You agree that the Sponsor will process Your personal data (First Name, Last Name and Email Address entered during Your entry) in accordance with applicable personal data protection laws, and may share such personal data with the Client. Purposes of data processing include organizing the Giveaway, evaluation of Your entry, communication with You, selection of the Winners and awarding the Prize. Your data will be processed based on:

1. Your consent, which You can withdraw at any time by contacting the Sponsor at snowreport@snowcommerce.com;

2. the Sponsor’s legitimate interests, such as the promotion of the Client's brand and other marketing purposes, as well as detecting fraud, abuse, other malicious activities, and/or enforcing or defending the Sponsor’s legal rights.

Provision of Your personal data is voluntary, but failure to provide the above-mentioned personal data will automatically exclude You from participation in this Giveaway. Your personal data will be retained for as long as necessary for the above-mentioned purposes and as long as there is a legal basis for data processing. For example, if You withdraw Your consent, Your data will be deleted, if it is not required to enforce or defend Sponsor’s legal rights. 13. Copy of Rules: To obtain a copy of these Rules, mail Your request along with a stamped, self-addressed envelope to: Snow Commerce, Inc. 1340 Clay St., Cincinnati, Ohio 45202, United States. Requests must be received no later than July 21, 2025 11:59PM, EST.
